Terms and Conditions

Agistment:

1. Madison Park Stables shall agist the horse or horses in such manner as it deems proper or appropriate;
2. The agistment fees will vary from time to time. Madison Park Stables will advise the owners in writing giving a 4 wk notifying period;
3. Agistment fees are to be paid one (1) month in advance, Direct Transfer being the preferred option;
4. Feed accounts are to be paid in arrears at the end of the month;
5. Madison Park Stables shall have absolute right to retain possession of any horse or horses untill all agistment fees relevant to all the owner's horses have been paid;
6. In the event that the agistment fees remain outstanding for a period of 30 days, Madison Park Stables shall have the right to offer for sale the horse or horses to which such fees relate by public auction and to apply the proceeds of sale thereof (after deduction of sale comission and expenses associated with such sale) firstly against all agistment fees outstanding in relation to the relevant horse or horses to the date of sale, together with interest thereon and any costs of Madison Park Stables associated with the sale and secondly, against any other agistment fees outstanding from the owner in relation to any other horse the owner has on agistment with Madison Park Stables with the balance, if any, to be paid by Madison Park Stables to the owner;
7. For the purposes of Clauses 4 & 5 of these Terms and Conditions the owner absolutely appoints Madison Park Stables his attorney with full power to deal with any horse or any moneys as the case may be and enter any horse for sale at a public auction, to instruct the auctioneers in relation thereto and to apply the proceeds there from in accordance with the terms of Clause 5 hereof;
8. If you are not the rightful owner of the horse being agisted at Madison Park Stables, but have it on lease from another party, the rightful owners must adhere to Madison Park Stables Terms and Conditions and must sign the Indemnity and Acceptance of Risk form on admission to Madison Park Stables;
9. All moneys owing must be paid in full before horse/s leave Madison Park Stables.

Payment:

These terms have been designed to make it as easy and hassle free as possible for us all. The less time we have to spend on administration the more time we can spend looking after your horse!

Costs are divided into Agistment Fee and Feed Costs.

Agistment Fee

• Paid monthly in advance and only by direct deposit.
• Paid on your start date and then the same day each month (eg 12th)
• Monthly amount is the weekly amount multiplied by 4.33 (52 weeks divided by 12)
• Preferred payment method is by internet transfer into our bank account. This can be set up as an automatic monthly payment so you don't have to worry about it.
• First month. The amount payable will be your monthly fee less your deposit.
• Last month. Worked out pro rata on number of days resident for the month.
• Short term stays less than one month. Estimate paid in advance.

Feed Costs

• Paid monthly in arrears
• Paid at the end of each calendar month and based on the number of days and hence feeds in that month.
• Drenching costs will be added to Feed Costs
• We will email you an invoice just after the end of every calendar month
• Terms are 7 days. Please pay on time - we don't have time for and don't enjoy following up money!

Indemnity and Acceptance of Risk:

1. I acknowledge that horses and activities involving horses are inherently dangerous and that by choosing to engage in horse activities I am assuming a risk of injury to myself, to the horses involved and to the others around me and that I or they and the horses might be injured. I acknowledge that by permitting my child to engage in such activities he/she will be exposed to the risk of injury and might be injured.
2. I acknowledge that my agreement to these terms is a fundamental condition of Madison Park Stables and Karyn Norris's agreement to provide me with their services.
3. In consideration of Madison Park Stables and Karyn Norris's agreement to provide me with certain services relating to horses, I will indemnify Karyn Norris, any persons assisting her, and the occupier of the land upon which I am engaging in horse activities, against any claims, liability or damage for any loss, harm or injury caused to me, or by me to others, or to any horses, in any way by through or in connection with such land, however such claim might arise and however the course of action might be framed, including but not limited to claims for breach of contract or in negligence, and whether I am a participant, spectator or assistant.
4. In consideration of Madison Park Stables and Karyn Norris's agreement to provide me with certain services related to horses, I hereby release Madison Park Stables and Karyn Norris, any persons assisting her, the occupier of any land upon which I am engaging in horse activities, from any claims, liability or damage for any loss, harm or injury caused to me, or by me to others, or to any horses, in any way by through or in connection with such horse activities or by the condition of such land, however such claim might arise and however the course of action might be framed, including but not limited to claims for breach of contract or in negligence, and whether I am a participant, spectator or assistant.
5. In the event that Madison Park Stables and Karyn Norris has been engaged to provide their/her services to a child whose name appears below, in consideration of Madison Park Stables and Karyn Norris's agreement to provide such a child with certain services relating to horses, clause 3 shall operate mutalis mutandis to provide a indemnity by me in favour of Madison Park Stables and Karyn Norris and any such occupier against any claim by such child against Madison Park Stables and Karyn Norris or such occupier and, to the extent permitted by law, shall operate as a defense, release and bar to any such claim.
